Commonwealth of Virginia - The Intrastate Commerce Act

An Act to amend the Code of Virginia by adding in Title 59.1 a chapter numbered 2.4, consisting of a section numbered 59.1-21.29, relating to Virginia product regulation; providing legislative intent; providing definitions; making products made in Virginia exempt from federal law or federal regulation; requiring certain identification mark on products manufactured or sold in Virginia; providing for codification; and providing an effective date.

Whereas, the 10th Amendment of the United States Constitution guarantees to the states and their people all powers not granted to the federal government elsewhere in the Constitution; and

Whereas, the 9th Amendment to the United States Constitution guarantees to the people rights not enumerated in the Constitution; and

Whereas, the regulation of intrastate commerce is vested in the states under the 9th and 10th Amendments to the United States Constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of products manufactured in Virginia.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Title 59.1 a chapter numbered 2.4, consisting of a section numbered 59.1-21.29, as follows:
59.1-21.29. Products made in Virginia are exempt from federal law or federal regulation.

A. As used in this act, the following definitions apply:

1. ”Manufactured” means any product made or built by a human being or machine; and
2. “Product” means anything distributed commercially for use or consumption. A product includes tangible personal property that is the result of fabrication or processing that has passed through a chain of commercial distribution before ultimate use or consumption which shall include all articles and items under the bureau of alcohol, tobacco, firearms.

B. This act applies to any product that is manufactured commercially or privately in Virginia from basic materials and that remains within the borders of Virginia shall not be subject to federal law or federal regulation. It is declared by the Legislature that these products have not traveled in interstate commerce.

C. Any product manufactured or sold in Virginia under the provisions of this act must have the words "Made in Virginia" clearly stamped on the product.

D. This act shall become effective July 1, 2011.
